Thank you for reading these Terms and Conditions. These Terms and Conditions govern your use of this website and any cake order.
1. An order ("Order") can be placed by telephone, email, fax or in writing to the address or number shown on the Contact Us page of this website. The placing of an Order shall constitue acceptance by you of these Terms and Conditions.
2. No Order shall be or shall be deemed to be accepted by Quintessential Cakes until
2.1 confirmation in writing ("the Confirmation") has been issued by Quintessential Cakes; and
2.2 you have paid to Quintessential Cakes the Deposit in accordance with clause 5 of these Terms and Conditions.
3. The Confirmation shall state the following:
3.1 the price for the cake(s) as defined in Clause 4 of these Terms and Conditions;
3.2 the delivery charge, if any, for the cake(s) ("the Delivery Charge");
3.3 the amount of any deposit ("the Deposit");
3.4 the balance of any payment due, including any Delivery Charge, and the dates on which such payment or payments are due ("the Payment Schedule");
3.5 the details of the Order, including, but not limited to, the type of cake, the date on which the cake is required ("the Delivery Date") and any specific agreements relating to the design of the cake.
4. The price for the cake(s) shall be as stated on this website, or where no price is stated on this website, shall be as agreed between you and Quintessential Cakes and set out in the Confirmation ("the Price").
5. You shall pay the Deposit to Quintessential Cakes within 7 days of the date of the Confirmation or as stated on the Confirmation, if different.
6. You shall pay the balance of the Price and the Delivery Charge ("the Balance") to Quintessential Cakes in accordance with the Payment Schedule.7. For the avoidance of doubt, the Deposit shall be non-refundable.
8. Cakes are available for collection at the address set out on the Contact Us page of this website by prior arrangement only.
9. Quintessential Cakes may, at your request, deliver the cake(s) to an agreed address subject to you paying the Delivery Charge in accordance with the Payment Schedule.
10. Quintessential Cakes may, entirely at its option, choose to use a third party to deliver the cake(s) to the agreed address. Quintessential Cakes accepts no responsibility for any loss or damage to the cake(s) incurred during transit by such a third party.
11. No cake(s) shall be delivered by Quintessential Cakes or be released for collection from Quintessential Cakes unless and until payment has been made in full in accordance with the Payment Schedule.
12. Subject to Clause 13 of these Terms and Conditions, you shall be entitled at any time to cancel the Order provided that such cancellation is made in writing and sent by email, fax or post to the address or number shown on the Contact Us page of this website.
13. In the event of any cancellation in accordance with Clause 12 of these Terms and Conditions or at all, you shall be liable to pay to Quintessential Cakes the following:
13.1 where such cancellation is made more than 40 Working Days prior to the Delivery Date, 0% of the Balance;
13.2 where such cancellation is made more than 30 Working Days prior to the Delivery Date, 50% of the Balance;
13.3 where such cancellation is made more than 15 Working Days prior to the Delivery Date, 75% of the Balance;
13.4 where such cancellation is made less than 15 Working Days prior to the Delivery Date, 100% of the Balance.
and for the avoidance of doubt, the term "Working Day" shall mean Monday to Friday inclusive but shall exclude Bank Holidays and for the purposes of this clause a cancellation shall be 'made' on the date on which it is received by Quintessential Cakes.
14. The copyright and all design and/or other moral rights in the cake(s), the website and any other designs, photographs or other documents or images produced by Quintessential Cakes shall remain at all times the property of Quintessential Cakes.
15. No person shall be entitled to copy, reproduce or otherwise make use of any image, photograph, design or other document or item produced by or on behalf of Quintessential Cakes without the prior written consent of Quintessential Cakes.
16. Quintessential Cakes shall be entitled to create and use for any purpose whatsoever, photographs or other images of any cake(s) designed, made, prepared and/or produced by or on behalf of Quintessential Cakes.
